I signed up with MonaVie and their literature told me that I could have my own website. After signing up and paying their fee, I started a website. I also ranked very high for MonaVie (selling only MonaVie products). They sent me a C&D letter and told me that ONLY the upper level people could have a personal website. They wanted me to get one of their subdomain websites (that will never rank!!!)

They are a bait & switch company! I left them and started selling a far superior juice…

The truth always comes out. Check out the numerous websites that indicate MonaVie is a scam. Their products are over priced JUNK. They have little or no nutritional value. To buy 2 bottles for one person at US$145 approximately makes no sense. Talk to any doctor and they will tell you to save your money and spend it on something the will really improve your life: Exercise and Real home Grown food. Monavie …oops I used that TRADEMARKED name again….I think I hear the Monavie GESTAPO police knocking at my door. Down with Monavie and stand up with Freedom of Speech and just plain common sense.

I went toâ€Help” a friend out at a “tasting party”…… Went thru the whole presentation and left on a wow if this works like they say it would be GREAT. Got home then started looking at the pricing and was amazed. Figured it out and to get “healthy” for ONE member of the house would be $150! That is 2 TWO complete family memberships the local YMCA!!! not just MY family but I could just pay for ANOTHER complete family to get “health”. Give me a break. I was telling my mother about the whole deal and the “I’ll just give you a bottle to try out” part of the presentation and she said “sounds like a Crack dealer.” To hear this from my Mom is almost fall down on the floor laughing because I had been thinking the same thing. LOL to see someone on the corner with a bottle of juice pushing it on people saying how “great” this stuff is but the only way you can afford to drink your Good Stuff is to push it on others.

Good luck to Monavie with their Bogus request to you and I am happy to stand with you against people who want to rip off unsuspecting honest Americans.

It’s interesting to see how Monavie is increasingly being promoted using â€œindependentâ€ websites to act as clearinghouses for illegal advertising materials. This one is absolutely riddled with material that violates U.S. law. But here’s the kicker; even though the site claims to be unaffiliated with Monavie, it’s openly run by a group of Monavie distributors and the site’s URL contains Monavie’s trademarked name:

Monavie LLC sent its lawyers after Lazyman in a futile attempt to bluff him into submission, and they did it using the gossamer thin pretense that their company’s name was included in his site’s meta-tags.

Monavie’s trademark infringement complaint against Layman falls to pieces. The company tacitly approves of sites bearing the Monavie trademark, and run by Monavie distributors, when it helps product sales through the distribution of illegal advertising materials.

I find it hilarious that Monavie even tries this since you are not selling a competitive product to them in any way.

Of course they want it down because they don’t want any negative press from it.

I will say they have a good product, but it is a bit overpriced for sure.

Buddy, that would apply only if trademark law applied in this case. It does not. As I’ve shown, they’d have to go after Newsweek and thousands of other sites. Every company would have to go after the New York Times every time they write an article.

Just FYI – it’s the legal system of the US that made Monavie send that email to you. If they don’t do anything to prevent others from using their patented/trademarked “property” (their name), then they lose the rights to it.

Isn’t Monavie the company’s name? How can you not be allowed to use the company’s name when referring to the company? Tell them to do a sanity check … and look up “nominative fair use” to calm yourself. As long as you’re not trying to pretend you’re Monavie then you can use their name to refer to them. I read the consumerist article, and was wondering when this little present would show up. The best part of that article, btw, was the excuse that you got an incorrect CDO because, “it must have been someone’s first day.” He/she payed thousands of dollars to go to law school, but writing a simple CDO about the right intended issue is still tough. Right.

I was thinking, a few well planned emails, tweets, etc, and you can organize 1000 bloggers to all produce a MonaVie post full of MonaVie tags. Their lawyers won’t be able to keep up with all the CDOs they’d need to send.

I have been reading LMAM for a few months and have been following this MonaVie issue since I’ve been a reader. Today’s post prompted me to call the coporated headquarters in Utah to speak with their legal team to express my dissappointment with their actions towards Lazy.

I called and spoke with an operater after grabbing their 800 number from their site. I let her know my concern that I feel MovaVie is trying to unjustly silence a third-party site and critics of its products.

Thirty minutes after speaking initally with MonaVie they decided to contact me back from their Marketing department. I did not request them to call me back — I guess they felt they needed to.

I spoke with Brian **** in marketing department (he was hesitant about giving the last name, asking if I was going to use this on the blog…lol). We spent over 30 minutes on the phone discussing my displeasure with MonaVie’s attempt to silence the critics. He kept trying to feed me the company lines about TITLES and TRADEMARK and META TAGS and BRAND. But every argument he had I was able to easily refute with common sense. My main point to him was that by attempting to silence the negative critism they are giving the preception that their product is a SCAM. I do not experience with their product other than the dust they keep kicking up with their CDO’s to Lazy Man.

FIGHT ON LAZY MAN! FIGHT ON! This is what the internet is for. Companies can not control the world. Especially if they are trying to perpetuate scams.
